An FIR was registered on Saturday against Flipkart founder Sachin Bansal and CEO Kalyan Krishnamurthy following a complaint of cheating lodged by a Ghaziabad-based lawyer.
The complainant, Naushad Chaudhary, alleged the company had sold him a laptop having features different from what was mentioned at the time of sale on the Flipkart app installed on his phone.
He claimed that Flipkart’s customer care had initially agreed to replace the product, but later stopped all communication with him. Chaudhary said he even sent a legal notice to company, but there was no response. “It is then that I lodged the complaint,” he said.
The charges mentioned by police include cheating, criminal breach of trust and forgery. Flipkart said on Sunday it would look into the matter.
According to the lawyer, he had bought the laptop (HP 15 APU Dual Core A6) for Rs 17,990 on October 12 last year under the “special offers” category for Diwali. He claimed that though the website mentioned that an Intel processor had been installed in the laptop he had bought, the gadget he received on October 22 had an AMD processor.
He raised a complaint with the customer care, which, in turn, promised to resolve the issue and refund the money. However, the complaint was “closed” saying there was a discrepancy in the lawyer’s claims and the seller had refused to take back the product.
Chaudhary said after the company did not respond to his legal notice, he approached a court and got an order passed for registration of an FIR against Flipkart on January 14.
A Flipkart spokesperson said: “As a marketplace, Flipkart serves to connect sellers with customers all over India. We strive to provide quick resolution to customers.”
